Think of this person or external organisation as an expert who you can rely on and call upon for advice and guidance on health and safety related matters as and when you need it.

When it comes to meeting and fulfilling Health & Safety legal duties and responsibilities, business owners and senior management can have peace of mind from having the support and guidance from a competent health and safety professional. 

The Management of Health & Safety at Work Regulations 1999 (MHSWR) outline the requirements for business owners to select “one or more competent persons to assist him in undertaking the measures he needs to take to comply with the requirements and prohibitions imposed upon him”. That person could be you or an employee, providing the right qualifications are held. Alternatively, you can opt to work with a specialist third party like Wiser Safety who can function as a Competent Safety Partner on your behalf.

At Wiser Safety, our Competent Safety Partner package is designed to ensure that your working practices, premises and equipment are safe and compliant with the relevant Health & Safety regulations and standards.

As the business owner, you will always bear the overall responsibility for managing health & safety in your business. Neither the appointment of an internal Health & Safety Manager or and external Competent Person can take that responsibility, it is therefore essential that you put the right people in place.  As your Competent Safety Partner, Wiser Safety can give you professional advice and support, to make sure that you are getting everything right and your business is on the right side of health and safety law. 

Listed below is a range of services that Wiser Safety can offer as part of our Competent Safety Partner package. Our approach is to understand the nature of your business and tailor the type of support that enables you to meet your statutory obligations. Businesses have varied requirements; we therefore use our expert knowledge to determine what type of support services and guidance you are likely to need.

On engaging us as your Competent Safety Partner provider, your organisation will be issued with a Certificate of Engagement , which will be valid for one year. The certificate is provided in a pdf format so that you can add it in Pre-Qualification Questionnaires (PQQ’s) and Tenders or you can display it on your noticeboard or elsewhere in  your office area.

Our Competent Safety Partner package will provide you with periodical advice and updates. This will include regular newsletters containing general advice along with any changes of legislation. We are also adept at getting your team engaged with your Health & Safety practices and promoting a Positive Safety Culture.

There are no long tie-ins, but the minimum period of cover for our Competent Safety Partner service is 12 months.

At Wiser Safety we really have your best interest at heart. We have a solid understanding of Health & Safety law, as well as being able to track updates so your business is kept up to date with any changes in legislation, making sure your business does whatever is necessary to remain compliant.

As this service is truly a customised service, you have the opportunity to select services that are most important to you. This means you design your own package and as such you only pay for the services you want rather than paying for services that you might not apply to your business.

As per the Management of Health & Safety Regulations 1999 (MHSWR):
A person shall be regarded as competent where they have sufficient training and experience or knowledge and other qualities to enable them to properly assist in the undertakings.

An external Competent Person service provider would provide:

  • Help/assistance (via a telephone helpline) on everyday health and safety issues which arise during the working day.
  • Advisory guidance by email or telephone relating to raised concerns, which in turn gives the interpretation of applicable health and safety legislation as laid down by the Health and Safety At Work Act 1974, associated Regulations, Approved Codes of Practice and Guidance.
  • Advice and updates as Health & Safety Legislation changes.
  • A regular Newsletter which includes topics of interest, changes to Health & Safety Legislation.

 

The service covers an office hours telephone helpline, and an optional access to 24-hr Emergency Telephone helpline.

 

Regulation 7 – Health and safety assistance
Every employer shall, subject to paragraphs (6) and (7), appoint one or more competent persons to assist him in undertaking the measures he needs to take to comply with the requirements and prohibitions imposed upon him by or under the relevant statutory provisions and by Part II of the Fire Precautions (Workplace) Regulations 1997.

Reg 7(1) requires employers to appoint one or more competent persons to  assist him in meeting his legal duties
Reg 7(2) requires the employer to make arrangements for ensuring adequate co-operation between the persons so appointed
Reg 7(3) requires the employer to ensure that the number of persons, the time available to them to undertake their functions and the means at their disposal are all adequate.
Reg 7(5) says that a person shall be regarded as competent where they have sufficient training and experience or knowledge and other qualities to enable them to properly assist in undertaking the measures required.

Your chosen Competent Person will depend on your circumstances. It could be: One or more of your workers. A third-party external partner to your organisation or it could be a combination of both. In this instance, an employer could appoint internally someone to manage health and safety with support from an externally appointed Competent Person.

UK legislation places a legal obligation on employers and business owners to provide employees with a safe and healthy work environment. Furthermore, you are required to protect visitors, contractors and members of the public visiting your premises. Employers that fail to do this are in breach of their statutory duty under Health and Safety Legislation.

This requirement to have a Competent Person extends to every workplace no matter how small or large the company is. Our Competent Person service scheme will assist you as the employer to ensure the legal requirements of health and safety law are met.
